1. Who We Are

Adetoun Adams Health & Wellbeing is a psychotherapy and counselling practice operated by Adetoun Adams, MBACP (Accred), associate member of the Chartered Institute of Counselling in Nigeria (CICN). We provide talking therapy services, oncology-focused counselling, and digital wellbeing resources (including The Cancer Companion: The First Steps).

This policy applies to visitors of our website, prospective clients, current and former clients, newsletter subscribers, and purchasers of our digital products. It is written to comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Where we process personal data of individuals in Nigeria, we also aim to align with the Nigeria Data Protection Act 2023 (NDPA) and guidance from the Nigeria Data Protection Commission (NDPC), pending finalisation of our Nigeria-facing services.

Special category data: Because we provide mental health and oncology-related counselling, clinical records may include information about your physical and mental health, and in some cases information about family relationships, bereavement, or other sensitive personal circumstances. This is treated as special category data under UK GDPR Article 9, and we process it only under the conditions set out in Section 4.

We do not knowingly collect data from anyone under 18. Our services are for adults only (see Section 8).

3. How We Use Your Information

We use your information to:

  • Respond to enquiries and assess suitability for therapy

  • Schedule, conduct, and follow up on sessions

  • Maintain accurate clinical records in line with professional and ethical obligations

  • Process payments for sessions and digital products

  • Send newsletters or updates you have opted into

  • Meet legal, regulatory, and insurance obligations

  • Improve our website and services

We do not sell your personal data, and we do not use clinical information for marketing purposes.

4. Our Legal Bases for Processing

  • Contract: to provide therapy services or fulfil a digital product purchase you've requested.

  • Consent: for newsletter sign-ups, and for the processing of special category (health-related) data as part of therapy, which we also treat as necessary for the provision of healthcare/treatment by a professional subject to confidentiality obligations (UK GDPR Art. 9(2)(h)).

  • Legitimate interests: for basic website analytics and administrative communications, where this does not override your rights.

  • Legal obligation: where we are required to retain or disclose records (e.g. safeguarding law, court order, professional body requirements).

5. Confidentiality of Therapy Records

Clinical notes are kept confidential in line with MBACP ethical guidelines. Limits to confidentiality include:

  • Where there is a serious risk of harm to you or another person

  • Where disclosure is required by law (e.g. safeguarding concerns, court order)

  • Anonymised case material may occasionally be discussed in clinical supervision, as required by professional practice — this never includes identifying details

Clinical supervision is a professional requirement, not optional, and helps ensure safe, ethical practice.

6. Who We Share Data With

  • Calendly (scheduling) — processes booking data

  • Stripe / PayPal (payments) — process payment data; we do not store full card details

  • Zoom (video sessions) — processes call connection data

  • Email marketing platform (newsletter) — processes subscriber email addresses

  • Clinical supervisor — anonymised discussion only, as above

  • Regulatory or legal bodies — only where legally required

We do not share your information with third parties for their own marketing purposes.

7. International Data Transfers

Some of our service providers (e.g. Zoom, Stripe, PayPal, Calendly) may process data outside the UK, including in the United States. Where this occurs, we rely on those providers' Standard Contractual Clauses or equivalent UK-approved safeguards.

8. Age Restrictions

Our services are intended for adults (18+) only. We do not knowingly provide services to, or collect data from, minors. If you believe a minor has provided us with personal data, please contact us so we can delete it.

9. Data Retention

  • Clinical/therapy records: retained for a minimum of 7 years following the end of therapy or last contact, in line with common UK professional indemnity guidance. (Please confirm this figure against your specific professional indemnity insurer's requirements and MBACP's current guidance — retention periods can vary, and higher-risk case files are sometimes retained longer.)

  • Payment records: retained as required by UK tax law (typically 6 years).

  • Newsletter data: retained until you unsubscribe.

  • Enquiry data from non-clients: retained for up to 12 months, then deleted if no therapeutic relationship begins.

10. Your Rights

Under UK GDPR, you have the right to:

  • Access the personal data we hold about you

  • Request correction of inaccurate data

  • Request erasure, subject to our legal and professional retention obligations

  • Restrict or object to certain processing

  • Data portability, where applicable

  • Withdraw consent at any time (this does not affect processing carried out before withdrawal)

  • Lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk, or with the Nigeria Data Protection Commission (NDPC) where applicable

11. Security

We take reasonable technical and organisational measures to protect your data, including secure storage of clinical records and use of reputable third-party processors. No system is completely secure, and we cannot guarantee absolute security of data transmitted online.

12. Changes to This Policy

We may update this policy from time to time. The "last updated" date at the top will reflect the most recent revision. Significant changes will be communicated where appropriate.
